Dell Inspiron 23 5348 touch screen not working

I've had Dell Inspiron 5348 All-in-one PC since end of May and have been very happy with it.  Then on Sunday the touch screen stopped working!  I've tried Hardware troubleshooting, Dell diagnostics, updating Dell and other drivers with no joy.  Went on-line to chat support, they remoted to my PC but could not restore the touch screen.  Then I was told that I have to do the restore.  I did refresh first, no joy, then restore OS and the touch screen is still not working, I lost lots of updates and settings and now some Windows updates are failing to install, some functions have disappeared etc.  They say I have to call the support and let them to reinstall Windows, this will take another evening and I don't have the time.  In addition to the stress the online support guy emailed me that if the PC is sent to them under warranty they only cover hardware, will wipe it clean and reinstall only OS (Windows 8.1), but will not reinstall any software what was there when I bought it.  This cannot be right!  I have the right as a consumer to expect the PC to work and if it breaks down it's up to Dell to fix it to the state it was when I first got it!  If not I want my money back!  Has anyone else got this sort of treatment with the warranty repair?  I go to small claims court if I get a PC back with no software in it!  How am I supposed to use it?  I'm not an IT engineer and all this is super stressing!
